Frequently Asked Questions
Straight answers, before you decide.
The questions Broward County families ask most after an accident — answered plainly by the attorney who would handle your case. When you're ready, the review is free.
How much does it cost to hire DiStefano Law?
Nothing up front. Personal-injury cases are handled on a contingency-fee basis, which means the firm's fee is a percentage of what we recover for you — and there is no fee at all unless we win or settle your case. The initial case review is always free and confidential, and you are never asked for money out of pocket to get started.
How long do I have to file a personal injury claim in Florida?
For most negligence-based injury claims arising on or after March 24, 2023, Florida law gives you two years from the date of the accident to file a lawsuit. Different deadlines apply to claims against government entities, wrongful-death cases, and certain other matters — and critical evidence fades long before any deadline. The safest course is to have your case reviewed as soon as possible so no rights are lost.
How do I know if I actually have a case?
The only way to know is to have the facts reviewed by an attorney. Generally, you may have a claim if someone else's negligence caused you harm — a careless driver, an unsafe property, a defective product, or a medical provider who fell below the standard of care. In a free, no-obligation call, Robert DiStefano will tell you honestly whether he believes you have a case worth pursuing.
Who will actually handle my case?
Robert DiStefano does. DiStefano Law is a senior-attorney practice, not a volume firm with a call center. The attorney who reviews your file, gathers the evidence, negotiates with the insurer, and stands up in court is the same attorney whose name is on the door — from your first call to your final check.
Will my case have to go to trial?
Most cases settle without a trial, and a fair settlement is always the first goal. But insurers offer fair value far more readily to an attorney who is genuinely prepared to try the case. Every file at DiStefano Law is built as though it will be tried — which is precisely why so many resolve favorably before they ever reach a courtroom.
What is my case worth?
No honest attorney can put a number on a case before reviewing it. The value depends on the severity of your injuries, your medical costs and lost income, the long-term impact on your life, and the insurance coverage available. What we can promise is a careful, candid assessment — and a refusal to let the insurance company decide your claim's value for you.
What should I do after an accident in Broward County?
Get medical attention first — for your health and for the record it creates. Then, if you safely can: document the scene with photos, collect names and contact information for anyone involved or who witnessed it, and keep every bill, report, and piece of correspondence. Avoid giving a recorded statement to the other party's insurer until you've spoken with an attorney. Then call us — the sooner we can preserve evidence, the stronger your claim.
Do I have to pay anything if we don't win?
No. On a contingency-fee arrangement, if there is no recovery there is no attorney's fee. You take on the insurance company without taking on financial risk — that is the entire point of how injury cases are handled.
